SUMMARY:Series of webinars: The Data Act in contracts
DESCRIPTION:Help us develop model contractual terms for data sharing and standard contractual clauses for switching between data processing services (cloud computing contracts) by sharing your opinion. \n\n\n\nBefore the Data Act starts applying from 12 September 2025\, the Commission will recommend model contractual terms for data access and use and standard contractual clauses for cloud computing. The Commission has set up an Expert Group to develop these models\, which will form the basis for the Commission Recommendation in 2025. These models intend to help especially small and medium-size companies and other organisations which may lack resources to draft and negotiate fair contractual clauses for data sharing or for cloud computing. \nIn November and December 2024\, the Commission will be hosting a series of 6 webinars with businesses\, policymakers\, lawyers\, and experts to discuss the development of both the draft Standard Contractual Clauses (SCCs) for cloud computing contracts and the draft Model Contractual Terms (MCTs) for data sharing. \nThe webinars are open to Member State authorities\, companies\, lawyers\, professors\, and organisations. You can register via the links below to take part in the discussions and help shape the contracts. Note that registrations will only be accepted if a professional email address is provided. \nFollowing registration\, participants will receive a Webex link and relevant documentation to support the discussion (including draft model terms and clauses) a few days before the event. \nWebinars\n20 November – Standard Contractual Clauses (SCCs)\nThis webinar will cover SCCs implementing the provisions of the Data Act: Switching and Exit\, Termination\, Security and business continuity. Registration fom \n21 November –  Standard Contractual Clauses (SCCs)\n\nThis webinar will cover SCCs on Liability\, Non-amendment\, Non-dispersion. Registration form \n27 November  – Model Contractual Terms (MCTs)\nThe topics covered in this webinar includes the contract between data holders and data users\, as well as the data use by the data holder\, arrangements for access to data by the user\, and transfer of the connected product to successors. Registration form \n28 November – Model Contractual Terms (MCTs)\nThe topics covered in this webinar includes the contract between data holders and data recipients but also the link with the user’s request\, the contract between the data recipient and the user\, as well as the ways in which data can be accessed by the data recipient. Registration form \n4 December – Model Contractual Terms (MCTs)\nThis webinar will cover the reasonable compensation for making data available agreed between data holders and data recipients under the Data Act\, as well as a possible compensation for the user in exchange of access and use of the data by the data holder in certain circumstances (for example when the user agrees not to share the data with other entities). Registration form \n5 December – Model Contractual Terms (MCTs)\nThis webinar covers voluntary data sharing and is relevant for bilateral or multilateral data sharing agreements but also for the use of MCTs in data spaces. Registration form

As a new aspect of this year’s conference\, there will be a call for demonstrations where a select few will be able to demonstrate their solutions to the conference audience. \nThe second and third day of the conference will then be dedicated towards providing a holistic view of the fast-changing landscape. Topics such as EOSC\, the Data Spaces\, the connection with HPC and handling sensitive data will be tackled in dedicated sessions that provide a view of developments on a European level. At the same time a session will also be dedicated to looking at individual national experiences and best practices providing various perspectives from the EUDAT members. This EUDAT Conference also aims to showcase more outside perspectives with calls for sessions. \nWhy participate?\nDon’t miss out on the research data management conference in Europe. \n\nJoin as an attendee and get acquainted with the latest advances in research data management in Europe and beyond.\nShare and discuss your innovation or developments with delegates from different research fields that use alternative solutions.\nExchange best practices and experiences.\nGet visibility and participate as an exhibitor\, or present your demos and posters or in sessions!\n\nWho should attend\n\nGerman National Research Data Infrastructure (NFDI) representatives and initiatives\, to showcase developments and establish or strengthen links with the EUDAT and wider community.\nResearchers and citizen scientists\, repository and community managers to discover services for research data management\, storage\, preservation and sharing.\nActors in the EOSC community\, ESFRI\, science clusters\, and research infrastructures to get the latest on the state of the art and use cases of some of the core services for supporting European research\nProjects\, research institutions and national and European initiatives to gain visibility and network with stakeholders to further their activities\nService providers to learn what EUDAT can offer from them\nCurrent and prospective EUDAT users and user communities to learn about new major functionalities\n\nRegistrations to launch on or before July 2024.  \nOpen Call for Sessions\, Workshops and Presentations\nAs part of the aim of the EUDAT Conference this year to be more inclusive\, provide a space for the community to introduce new ideas\, as well as establish closer links with new communities\, an Open Call for Sessions\, Workshops\, and Presentations is being launched.
